Terms of Use
Last updated 15 October 2026. This is the same document the app shows, at a plain address. The Privacy Notice is beside it.
Who We Are and What This Is
DinnerCount is made by Human Messenger LLC, a Virginia company (“we”, “us”). These terms are the agreement between you and us. You accept them when you check the box and continue, and by using DinnerCount. If you do not agree, do not use it. You must be 18 or older to accept these terms, start a trial, buy DinnerCount, or hold a household account. DinnerCount is offered to customers in the United States.
What DinnerCount Is
DinnerCount is a meal-planning tool for private households. It stores recipes, sizes amounts to the people eating, builds a shopping list, and keeps track of the staples you have on hand. It is not built for restaurants, schools, daycares, care facilities, or other food service. It does not give dietary, nutritional, medical, or food-safety advice, and it does not replace your own judgment in your own kitchen. Nothing in DinnerCount creates a professional relationship of any kind.
Your Kitchen, Your Responsibility
Cooking involves heat, sharp tools, raw ingredients, and allergens. Those risks arise in your kitchen and not in software. You accept them whenever you cook, whether the recipe comes from DinnerCount or from anywhere else.
Every safety aid in DinnerCount (the temperatures, the warnings, and the step markings) is an aid. Each one is generated by software that reads recipe text and can be wrong. None of them replaces an attentive adult. You are responsible for how food is prepared, cooked, and served in your home.
Food Safety
DinnerCount shows suggested minimum internal cooking temperatures. These are general figures published by the USDA and FoodSafety.gov, and software matches them to recipes automatically. They are not specific to your dish, your ingredients, your equipment, or your altitude. The matching is done by reading recipe text, which can be wrong. The figures are no substitute for a food thermometer and your own judgment.
Cooking times in recipes are estimates. Always check doneness yourself with a thermometer. Color is not a reliable test. For packaged products, the directions on your package are the authority. Follow them over anything shown here.
You are responsible for safe food handling (storage, thawing, cross-contamination, cooling, and reheating). If a recipe or a temperature shown here looks wrong to you, trust yourself and not the app.
Allergens
DinnerCount shows “Contains” warnings that are worked out from the text of ingredient names only. They are a floor, not a ceiling, and they are not a complete allergen list. The software cannot see inside a jar, a packet, a sauce, or a mix. It can miss an allergen entirely. It does not know your brand, a changed formulation, or anything about shared production lines and cross-contact.
The absence of a warning is never a statement that an allergen is absent, and a warning that appears is never a promise that it is complete.
DinnerCount keeps no dietary or allergy profile for anyone in your household, and never decides whether a recipe suits a person. The only thing it says about what a recipe contains is the Contains line, which is read from ingredient names.
Do not use DinnerCount to make allergy decisions. If anyone in your household has a food allergy or intolerance, read the packaging on every product, every time, and follow the guidance of your clinician and not this app.
Anyone Helping in the Kitchen
An adult must actively supervise anyone under 18 in the kitchen, at all times. Never leave a child unattended with heat, blades, hot liquid, raw food, or appliances, whatever this app says. DinnerCount makes no claims about what any particular person can safely do. Software can miss a hazard it has no word for. You, and not the app, decide who does what in your kitchen.
Your Household Account
Your household account is created when you start a trial, buy DinnerCount, or use a code, and it is for the people who live and plan meals together. The account is identified by its email address, and that address is the key to it. Anyone who can read that inbox can sign in and change your household and its devices, so use an address the adults in your home control, keep it secure, and tell us at once if you lose control of it. You are responsible for every device you sign in or add, for what is entered on those devices, and for removing devices you no longer control. The Account card lists your signed-in devices. A household may have up to ten signed-in devices. We may remove devices or end a household’s access if access is shared beyond the household, resold, used to reach another household’s data, or used to break the law.
The Shared Household
Signing in connects a device to your shared household. This is one copy of your household’s data, kept encrypted on our servers so that every device shows the same information. Each device keeps its own copy and works without a connection. Changes are sent when the device is online.
Sharing is a convenience, not a guarantee. When two devices change the same thing while apart, the later change may win. The shared household may be unavailable from time to time. None of this affects the copy already on your device. Keep a backup of anything you would mind losing. Backup exports everything at any time.
Your Free Trial
Your trial lasts 14 days from the day you start it and includes everything in DinnerCount. It needs only an email address, with no card and nothing to cancel. One trial is available per email address. We email you before your trial ends. When the trial ends, you can buy DinnerCount to keep planning. If you don’t, DinnerCount keeps showing your household on your device and Backup still exports everything, but planning and sharing stop. We delete your household’s copy on our servers 30 days after the trial ends, unless you buy before then.
Buying DinnerCount
What you get. One payment gives your household a license to use DinnerCount. It is not a subscription, nothing renews, and the license does not expire. It includes every update and new recipe we release for 12 months from your purchase. After that, your DinnerCount keeps working, and the updates that keep it working and secure stay free for as long as we offer DinnerCount. These include fixes, compatibility with the phones and browsers you use, and the sharing service. A later edition with major new features may be sold separately. If so, we will offer it to existing households first, and the version you have keeps working whether or not you buy it.
Price and payment. Prices are in US dollars. The price, and any tax that applies, are shown before you pay. A change in price never affects a purchase already made. Human Messenger LLC is the seller. Our payment processor handles the payment, and we never see your card number.
Refunds. You have 14 days from purchase to change your mind, with no questions asked. Email us from the address you bought with, and we will refund the purchase in full to the original payment method. After 14 days, refunds are at our discretion. If your purchase is refunded or disputed, the shared household becomes read-only. Each device keeps working on its own copy, but changes are no longer sent between devices. If the same email address buys again, sharing resumes.
Codes. We may give out codes that unlock DinnerCount without a purchase, for example for creators or as gifts. A code grants the same household license under these terms, may be limited or withdrawn as stated with it, and may not be sold. For a code, the 12 months of updates and support run from the day you use it.
Your Content
You own the recipes, notes, and other content you enter. You give us permission to store, process, transmit, and display it only to run DinnerCount for your household. That permission does not cover training, publishing, or selling your content. Enter only content you have the right to use. The recipe-import features are for your household’s private use, not for republishing someone else’s work.
Our Content and Your License
The DinnerCount software, the original text we wrote, and the selection and arrangement of the recipe library are © Human Messenger LLC 2026. Ingredient lists and the underlying dishes are facts and methods that no one owns. The recipe pictures are AI-generated illustrations, and we make no claim to own them.
Your license is for your household’s private, non-commercial use. You agree not to scrape, copy in bulk, redistribute, or republish any part of DinnerCount, not to resell access, not to use it to build a competing collection, and not to probe, overload, or interfere with the service or try to reach another household’s data. Using Backup is always allowed. Product names in ingredient lists belong to their owners and are used only to identify a product. DinnerCount is not affiliated with or endorsed by any of them. If you send us ideas or suggestions, we may use them without restriction or payment.
Copyright Complaints
If you believe something stored in DinnerCount infringes your copyright, send a notice to our designated agent under the Digital Millennium Copyright Act: Copyright Agent, Human Messenger LLC, 8401 Mayland Dr. #7708, Richmond, VA 23294, USA; phone 571-661-1400; email [email protected]. The same designation is on file with the U.S. Copyright Office. We respond to valid notices and counter-notices as that law provides, and we may close a household that repeatedly infringes.
If We Ever Stop Offering DinnerCount
An installed copy of DinnerCount keeps working even if our servers are unavailable. Only sharing between devices needs our servers. We commit to running sharing, and to answering email, for at least 12 months from your purchase, and for as long as we offer DinnerCount after that. If we ever stop offering it, we will email your household at least 30 days before sharing closes, and Backup will still export everything. If that happens within one year of your purchase, you may request a full refund, which we will pay to the original payment method.
Ending Your Use
You can stop using DinnerCount at any time. Sign out to stop sharing, or delete your household to remove it from our servers. Both are in the Account card. We may improve, change, or remove features, and we may suspend or end a household’s access for the misuse described above. Sections that should survive the end of this agreement, such as content licenses, disclaimers, limits on liability, and disputes, do survive.
No Warranty
DINNERCOUNT IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not promise it will always be available, that it is free of errors, that quantities or temperatures shown are correct, or that data will never be lost. Please keep your own backups. The Backup button exports everything to a file you keep.
The only exceptions: the commitments we make in the sections “Buying DinnerCount” and “If We Ever Stop Offering DinnerCount” are express promises, and they are the only warranties we give.
Limits on Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, THE TOTAL LIABILITY OF HUMAN MESSENGER LLC TO YOU, FOR ALL CLAIMS TOGETHER, IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US FOR DINNERCOUNT OR (b) US $25, AND EXCLUDES INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or gross negligence or willful misconduct, or for anything that the law does not allow to be limited. Some places do not allow some of these limits, particularly for personal injury. Where that is the case, the limits apply only as far as the law permits, and the rest of this section still stands.
Disputes
Contact us first. Email [email protected] with “Dispute” in the subject line, and allow us 30 days to resolve the problem.
These terms are governed by the law of the Commonwealth of Virginia, without regard to conflict-of-laws rules. Disputes that go to court belong exclusively to the state and federal courts located in Virginia. Nothing in these terms takes away consumer rights that the law of the place you live does not allow to be waived.
Either of us may bring an individual claim in a small claims court that has jurisdiction over it, in place of the courts above.
Changes and General Terms
Changes: we may update these terms. We post the new version in the app and at dinnercount.com/terms/ with its date. For changes that matter, the app asks you to agree again before you continue. If you do not agree, stop using DinnerCount. Backup exports your data, and Delete household removes it from our servers.
Notices: we contact you in the app and at the household email address. You contact us at [email protected]. You agree to receive notices, receipts, and these terms electronically, and you agree that an electronic copy counts as a written one.
Things outside our control: we are not liable for failures caused by events beyond our reasonable control.
General: these terms and the Privacy Notice are the whole agreement. If part is unenforceable, the rest stands. Not enforcing a term today does not waive it tomorrow. You may not transfer this agreement. Human Messenger LLC may assign it as part of a sale or reorganization, and whoever takes it on is bound by these terms and our Privacy Notice.
